York County manufacturer AMZ Manufacturing has struck a deal settling federal allegations that it failed to take adequate action after two women complained about sexual harassment at one of its plants.
The charges, filed last year, alleged violations of Title VII, the federal law barring discrimination based on race, color, sex, national origin or religion.
According to the original charges, male employees at AMZ’s plant at 2206 Pennsylvania Ave. in York created a hostile work environment by making offensive comments about the women’s appearance, including some that were sexually suggestive.
Under a consent decree with the U.S. Equal Employment Opportunity Commission, AMZ is paying $60,000 to one of the women and $50,000 to the other.
AMZ is not admitting any liability arising from the EEOC’s claims.
Are there other provisions: Yes.
The agreement requires the company to develop a new policy on sexual harassment and to designate a third-party attorney or consultant with expertise in Title VII and preventing sexual harassment to “promptly investigate” any discrimination complaints.
In addition, the decree calls on AMZ to provide training to owners, managers and workers on Title VII.
“I am pleased that this matter has come to a reasonable conclusion for all involved parties, particularly AMZ,” said Ed Paskey, a York-area attorney who represented the company. “While we were fully prepared to litigate the case to a successful verdict, this resolution allows both sides to focus their energy and resources on other matters. As always, AMZ remains committed to providing a safe and welcoming environment for all employees.”
EEOC officials also expressed satisfaction with the consent decree.
“Employers violate federal law when their managers engage in and tolerate a culture of sexual harassment,” Jamie Williamson, EEOC’s Philadelphia district director, said in a statement. “We are pleased that the consent decree reached in this case provides significant relief to ensure that sexual harassment is prevented in the future.”
